HomeScouted · Datika LTD
Terms of Use
Effective October 11, 2026 · Version 1.0
1. HomeScouted and these terms
HomeScouted at homescouted.com is operated by Datika LTD, established in Israel, company number 517410411 (“we,” “us”). Contact legal@datika.io. Our registered postal address is available on request and from the Israeli Registrar of Companies.
These terms cover our home-project guides and contractor-matching service. When you submit a project request using a form that presents these terms and an acceptance statement, you agree to them. A footer link alone is not evidence that you accepted a contract. Our Privacy Policy explains information handling; it is not blanket consent for any use of your information.
2. Eligibility and accurate requests
You must be at least 18 and have legal capacity to submit a request. Provide accurate information, a phone number you are entitled to use and only information you have authority to share. If acting for another person or business, you must have permission. The matching service covers eligible projects in Los Angeles County; coverage and availability may change.
3. How matching works and how we are paid
We check your project type, service area and available capacity and route the request to a contractor in our network. Up to three contractors may receive and contact you about one request, including reassignments. We do not guarantee a match, response time or estimate. If you provide an email address, we send the assigned contractor's name and contact details.
Requesting an estimate is free for homeowners. We may receive payment from contractors for qualifying leads. Our network does not include every contractor. A match is not an independent ranking, competitive tender or recommendation of the best contractor in the market. We do not promise that every contractor has been independently screened, licensed, insured or background-checked by us.
By requesting an introduction, you ask us to disclose the contact and project information needed for that introduction to matched contractors, subject to the Privacy Policy, your choices and applicable law. Paid referrals may constitute sales of personal information. This permission is limited to your project; it does not permit unrelated marketing, unlimited onward sales or general-purpose AI training using your submission.
4. Contractor services are separate
HomeScouted is a referral and information service. We do not perform construction, issue permits, act as your contractor or supervise work. Contractors set their own prices and terms. An estimate request creates no obligation to hire, and we do not collect payment for construction work through the request form.
Before hiring, check the contractor's current license and classification, insurance, references and written scope, price and payment schedule. Use the California Contractors State License Board lookup. Your construction agreement is with the contractor. Nothing here excuses us from duties imposed on our own conduct or services.
5. Calls, texts and emails
The separate contact disclosure on the request form explains the permission requested for calls and texts. These terms do not independently authorize prerecorded calls, automated marketing or unrelated contact. An active sale/sharing opt-out blocks contractor referrals even if you select contact consent or accept these terms; see our privacy choices. Each caller remains responsible for obtaining legally required permission and honoring do-not-call and withdrawal requirements.
Contact consent is not a condition of purchasing a contractor's goods or services. Message and data rates may apply. To withdraw contact permission, use the stop-contact link in a request email, tell the caller, reply STOP to a text where supported, or email privacy@datika.io. You may communicate withdrawal by another reasonable method. See contact choices. Withdrawal does not cancel a separate construction agreement.
6. Guides, estimates and public data
Guides, charts, calculators, images and cost figures are general planning information. Public permit valuations are not contractor quotes or necessarily final costs. Data may be incomplete or out of date. Check property eligibility, permits, codes and prices for your project with qualified professionals and the responsible authorities.
Some editorial material may be prepared with automated tools. Information can contain errors and is not architectural, engineering, legal, financial or safety advice. Inspiration images do not promise a result. Our methodology explains sources and limitations. A third-party link does not mean we control or endorse its content.
7. Permitted use and intellectual property
You may use the service for lawful research and project requests. Datika or its licensors own the site's original content, software and branding. You may keep or print material for personal, non-commercial use, retaining ownership notices. Rights in public records, third-party material and open-source software remain subject to their respective rights and licenses.
Do not submit false or unauthorized leads, impersonate others, harass anyone, distribute malware, attempt unauthorized access, bypass security or harvest personal information. Systematic extraction or reuse of protected content, including for model training, requires permission unless applicable law allows it. Nothing here restricts lawful fair use, interoperability or rights in public-domain information.
You retain rights in your submissions and give us the limited permission needed to process them and make the paid introductions in section 3. These terms grant no broader right to sell your content or use it for unrelated advertising. You remain responsible for unlawful use; we remain responsible for our own conduct.
8. Availability and misuse
We use reasonable care but cannot promise uninterrupted or error-free availability. We may make reasonable changes, restrict access or refuse requests to address misuse, security, legal obligations or service limitations. Where reasonably possible and lawful, we explain restrictions and allow you to contact us about mistakes. You may stop using the service at any time.
9. Disclaimers and liability
To the extent permitted by law, free guides and the free matching service are provided “as is” and “as available.” We do not guarantee contractor performance, approval, price, savings or completion, or that the service will meet needs we have not expressly agreed to meet.
Liability we do not exclude: nothing limits liability for fraud, deliberate wrongdoing, gross negligence, death or personal injury caused by our negligence, applicable data-protection duties, non-excludable consumer rights or other liability the law does not permit us to limit.
Subject to those protections and only as permitted by law, we are not liable for indirect or consequential losses, lost profits, or losses caused solely by an independent contractor or circumstances outside our reasonable control. On the same basis, our aggregate liability to you for this service in a 12-month period is limited to the greater of US $100 and the amount you paid Datika for this service in the 12 months before the relevant event. The exclusions and cap do not apply to losses for which applicable law makes us responsible and does not permit a limitation.
These terms preserve mandatory California consumer protections and other rights and remedies that cannot lawfully be waived. They do not make you responsible for Datika's own breach or negligence.
10. Governing law and disputes
Subject to mandatory law, these terms are governed by Israeli law and the competent courts of Tel Aviv-Jaffa have jurisdiction. Consumers retain any right under applicable law to rely on mandatory protections or bring proceedings in their home jurisdiction, including protections available to California consumers. Either party may seek urgent protective relief in a court with jurisdiction.
These terms impose no mandatory arbitration or class-action waiver. We welcome concerns at legal@datika.io, but contacting us first is not a condition of exercising legal rights.
11. Changes and general provisions
We identify the version and effective date of these terms. Material changes receive any required notice and renewed acceptance. Changes do not retroactively remove rights or govern an existing dispute merely because we publish a new page. Continued browsing alone does not establish acceptance of a material amendment.
If a provision is unenforceable, the rest continues to the extent legally possible. Delayed enforcement is not a waiver. A transfer of this service must preserve contractual and statutory protections. These terms and any specific agreement you accept describe your agreement with Datika; your contractor agreement is separate. Ownership, accrued rights, liability and dispute provisions continue where needed after use ends. Information handling remains governed by the Privacy Policy and law.
